Ocurre que faltan elementos, como el dolo, para que se configure el tipo penal de la interferencia de las comunicaciones.<\/div>\n<div style=\"text-align: justify\"><a name='more'><\/a><\/div>\n<div style=\"text-align: justify\">Otro argumento al que el juez le dio gran importancia fue que no se puede criminalizar a un medio comunitario, alternativo y popular. \u201cNo corresponde a este tribunal pronunciarse sobre la cuesti\u00f3n vinculada al derecho que en definitiva le asiste o no a la Cooperativa de Trabajo Antena Negra TV Ltda. y\/o a la empresa General Industries Argentina S.A. de utilizar esa porci\u00f3n de espectro, ya que ello corresponde ser planteado en la \u00f3rbita administrativa pertinente, so riesgo de intervenir el suscripto en competencias ajenas que exceden ampliamente las atribuciones conferidas por la Constituci\u00f3n Nacional para su tratamiento\u201c, concluye el fallo.<\/div>\n<div style=\"text-align: justify\"><\/div>\n<div style=\"text-align: justify\">Qued\u00f3 demostrado que <b>Antena Negra TV afronto una causa donde nunca existi\u00f3 el delito<\/b>. PROSEGUR y la Polic\u00eda Federal llevaron adelante un proceso legal que deriv\u00f3 en el secuestro de equipos y destrozos en el canal. Antena Negra fue dejada sin aire el 4 de septiembre por un delito que nunca cometi\u00f3.
