Adem\u00e1s, orden\u00f3 que se restituyan las parcelas a dos comunidades ind\u00ecgenas.<br \/>Las comunidades Mapuche de \u00abSierra Colorada\u00bb y \u00abLago Rosario\u00bb, del departamento Futaleuf\u00fa, en la provincia de Chubut, obtuvieron una victoria en la justicia provincial. Una sentencia firmada el jueves pasado por un juez de Esquel orden\u00f3 que se le restituyan unas tres mil hect\u00e1reas que fueron vendidas ilegalmente en 2010 en <b>un contrato privado de permuta.<\/b><\/span><br \/><a name='more'><\/a><span style=\"font-size: small\"><span style=\"font-family: Verdana,sans-serif\">El Juez Civil de Esquel, Marcelo Peral, declar\u00f3 la nulidad de ese contrato porque \u201cla propiedad comunitaria ind\u00edgena se trata de un derecho real aut\u00f3nomo\u201d que \u201cse ejercita en relaci\u00f3n directa con la tierra sobre la que recae\u201d. Adem\u00e1s orden\u00f3 que se restituyan esas tierras a la comunidad en 10 d\u00edas desde que la sentencia quede firme.<br \/>El juez tuvo en cuenta,  que la comunidad est\u00e1 reconocida por el Estado Nacional, y una gran cantidad de normas que se encuentran en la Constituci\u00f3n Nacional, la provincial y la internacional donde se plasma \u201cla prohibici\u00f3n de vender, arrendar, transferir derechos sobre la unidad que se le adjudica a una comunidad aborigen, protegiendo as\u00ed a los pueblos originarios\u201d. <\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00a1\u00a1\u00a1UN POCO DE JUSTICIA!!!
